I enjoy appellate work because of the abstraction, sophistication, and intellectual stimulation it involves. It requires objectivity and critical judgment but also the ability to think creatively. Too often, attorneys in appeals make the mistake of revisiting factual issues that were lost in the trial court or re-arguing the same weak legal issues. The hallmark of a good appellate attorney is the ability to focus objectively on potential legal errors, while accepting the factual record as it is and analyzing the case candidly. I try to look at cases from the same perspective that the appellate judges will see them in order to give clients the thorough and honest advice they deserve.
